    Animal Trusts
According to attorney Shawn K. Deasy, who specializes in animal welfare law, pet owners can take steps now to ensure that their animals are cared for in case they're unable to do so. One possibility is a will which can include Powers of Attorney to handle assets in the event of the owner's incapacitation or death. It can also establish a testamentary trust providing money to be used for your animal's care. The cost for preparing a will is approximately $300 + tax. Another option is a living trust, which can also include a testamentary trust for animals. A trust avoids probate which can take up to a year and cost up to $3,000. The fee for preparing a living trust runs from $1200 - $1800.
Ms. Deasy cautions against trying to write your own will or trust using do-it-yourself legal books--they're usually not valid in New Mexico. To contact Ms. Deasy about preparing your will or trust, call her at 873-2952.
